purpose of receiving written public comments on the proposed rules and

K.A.R. 40-7-5. Agents; signatures; powers
of attorney; rubber-stamped facsimiles; mechanical devices. This proposed regulation defines acceptable uses of
authorizing signatures and facsimile signatures by agents. The changes to K.A.R. 40-7-5 are technical
only.
There is no economic impact on
insurers, consumers, the Kansas Insurance Department, and other governmental
agencies, if any.
K.A.R. 40-7-7. Agent’s’; resident procedure for obtaining licenses
and company certification.. This proposed regulation defines
the procedure for resident agents to obtain licenses and company
certification. The primary changes
include the deletion of the procedures for obtaining a license. The remaining regulation now address the
procedure for obtaining company certification only while the remaining changes
to K.A.R. 40-7-7 are technical.
There
is no economic impact on insurers, consumers, the Kansas Insurance Department,
and other governmental agencies, if any.
K.A.R. 40-7-7a. This regulation provides the
procedure for nonresident agents to obtain a license and company certification.
The proposed revocation of this
regulation would have minimal impact on insurance agents, insurance companies,
the Kansas Insurance Department, other governmental agencies, and consumers.
K.A.R. 40-7-9. Agents; change in the information contained
on the most recent application for a license.
This
proposed regulation defines when agents must file a report with the
Commissioner of Insurance for actions taken against them or for changes in
their information. The changes to
K.A.R. 40-7-9 are technical only.
There is no economic impact on
insurers, consumers, the Kansas Insurance Department, and other governmental
agencies, if any.
K.A.R. 40-7-20a. Agents; brokers;
continuing education; approval of courses; requirements. This proposed regulation defines terms that are used in the
regulation, requirements for receiving approval for, and credit for continuing
education units, and penalties for providing false information in connection
with continuing education units.
The proposed changes include
clarifying the types of courses that are required. Specific changes include
removing the prohibition of courses that primarily impart knowledge of specific
products of specific companies if the course relates to sales promotions or
marketing of the products, removing the requirement that a listing of approved
courses be made available to the public upon request, and revising requirements
for instructors. The remaining changes
to K.A.R. 40-7-20a are technical only.
