Proposed Regulation K.A.R. 40-1-32
K.A.R. 40-1-32. Insurance companies; riders or endorsements;
change in coverage or benefits; consent of policyholder insured;
definitions. Consent of the
policyholder is required if an endorsement or rider attached to an insurance
contract or policy subsequent to the issuance date of such contract or policy
reduces or eliminates coverage or benefits of the contract or policy. As used in K.S.A. 40-2404(9)(i) and
amendments thereto, these terms shall have the following meanings:
(a) “Altered”
means that a contract or policy has been changed after the issuance date of the
contract or policy to reduce or eliminate the coverage or benefits of the
contract or policy.
(b) “Application”
means an insurance policy or contract.
(c) “Consent”
means a statement signed by an insured and filed with an insurance company.
(d) “Notice”
means an endorsement or a rider attached to each insurance contract or policy.
