40-5-104 Same;
coverage without separate charge.
(a) If no
separate charge is made to the consumer for consumer credit insurance, the
consumer shall be charged a specific amount for insurance if an identifiable
charge for insurance is disclosed in the credit or other instrument furnished
the consumer setting out the financial elements of the credit transactions, or
if there is a differential in the finance charge (as defined in section
16a-1-301(19)) made to consumers in like circumstances, except for their
insured or non-insured status.
(b) The rate standards set out in K.A.R. 40-5-107 shall apply to the
premiums for consumer credit insurance. The insurer issuing the coverage must
obtain form and rate approval by the commissioner.
